Use of Our Website
Our website is provided for your personal, non-commercial use to explore our services, schedule appointments, and contact us. You agree to:
- Use the website in compliance with all applicable laws and regulations.
- Refrain from unauthorized access, hacking, or distributing viruses or malicious code.
- Not reproduce, modify, distribute, or sell website content without our prior written consent.
- Provide accurate and complete information when submitting forms, scheduling appointments, or contacting us.
- Avoid using automated tools (e.g., bots, scrapers) to access, collect, or manipulate data from our site.

Service Agreements and Policies
When you request services (e.g., diagnostics, repairs, or maintenance), you enter into a service agreement with Babylon Automotive. Key terms include:
- Scheduling and Authorization: You must provide accurate vehicle information (e.g., make, model, symptoms) to enable proper diagnostics and repairs. We provide a detailed estimate before major repairs, and your approval (verbal, written, or electronic) authorizes us to proceed.
- Service Scope: Services are based on the agreed-upon estimate but may require adjustments if additional issues are identified. We will communicate any changes and obtain your approval before proceeding.
- Parts and Materials: We use high-quality parts, either new or remanufactured, sourced from reputable suppliers. If you provide your own parts, we cannot guarantee their performance or warranty the service.
- Completion and Delivery: Service completion depends on parts availability, vehicle condition, and technician schedules. We aim to meet estimated timelines but are not liable for delays beyond our control.
- Customer Responsibilities: You must disclose known vehicle issues, ensure the vehicle is accessible for service, and remove personal belongings. Babylon Automotive is not responsible for loss or damage to items left in the vehicle.
We reserve the right to refuse service for vehicles deemed unsafe, non-compliant with legal standards, or outside our expertise.
Payment Terms
Payment for services is due upon completion unless a prior arrangement is made. We accept cash, credit/debit cards, and approved digital payment methods. Payment terms include:
- Pricing: Based on labor, parts, shop supplies, and applicable taxes, as outlined in your estimate or invoice. Estimates are subject to change if additional repairs are needed.
- Additional Work: If unforeseen issues arise, we will provide a revised estimate and proceed only with your approval.
- Late Payments: Overdue balances may incur a late fee of 1.5% per month (or the maximum allowed by law) after 30 days.
- Non-Payment: Failure to pay may result in suspension of future services, vehicle retention until payment is cleared, or legal action to recover owed amounts.
- Refunds: Refunds for services are issued at our discretion, typically within 14 days, if the service was not performed as agreed or was defective, subject to inspection.
Warranties and Guarantees
We stand behind our work with the following limited warranties, subject to applicable consumer protection laws:
- Parts: Covered by the manufacturer’s warranty, typically 12-24 months, unless otherwise specified. Defective parts will be replaced at no cost, subject to supplier terms.
- Labor: Warranted for 90 days or 4,000 miles (whichever comes first), provided the vehicle is not misused, modified, or damaged post-repair.
- Exclusions: Warranties do not cover wear-and-tear items (e.g., brakes, tires), customer-provided parts, or damages from accidents, neglect, or failure to follow maintenance recommendations.
To claim a warranty, contact us at Ap@babylon-auto.com with proof of service (e.g., invoice). We will inspect the issue and, if covered, repair or replace at no additional cost. No other warranties, express or implied (including merchantability or fitness for a particular purpose), are provided unless required by law.
Limitation of Liability
To the fullest extent permitted by law, Babylon Automotive, its employees, and affiliates are not liable for:
- Indirect, incidental, special, or consequential damages (e.g., loss of use, lost profits, rental car costs) arising from our services, website use, or delays.
- Damages exceeding the amount paid for the specific service or repair in question.
- Issues caused by pre-existing vehicle conditions, customer-provided parts, third-party repairs, or failure to follow our recommendations.
- Loss or damage to personal property left in the vehicle during service.
Our liability is limited to performing services with reasonable care and skill, in accordance with industry standards.
Indemnification
You agree to indemnify, defend, and hold harmless Babylon Automotive, its owners, employees, and affiliates from any claims, damages, losses, or liabilities (including legal fees) arising from:
- Your misuse of our website, services, or scheduling tools.
- Inaccurate, incomplete, or fraudulent information you provide.
- Your failure to maintain or operate your vehicle safely post-service, leading to damages or injuries.
- Any breach of these Terms or applicable laws.

- Treat our staff, contractors, and other customers with courtesy and respect.
- Refrain from abusive, threatening, or harassing behavior, whether in-person, over the phone, or online.
- Comply with shop policies, including safety protocols, when visiting our facility.
We may terminate services or refuse future business for conduct that violates these standards, without prejudice to other remedies.
Termination of Services
Babylon Automotive may terminate or refuse services at our discretion, including for:
- Non-payment of invoices or outstanding balances.
- Abusive or unsafe conduct toward staff or customers.
- Requests for services beyond our expertise, unsafe vehicles, or non-compliance with legal standards.
- Fraudulent or misleading information provided during scheduling or service.
Upon termination, you remain liable for all charges incurred. Vehicles left unclaimed for 30 days after service completion may be subject to storage fees of $25 per day or disposal, per Texas law.

You may not copy, reproduce, distribute, or create derivative works without our prior written consent, except for personal, non-commercial use (e.g., printing a service page for reference). Unauthorized use may result in legal action.
Privacy and Data Usage
Your use of our website and services is also governed by our Privacy Policy, available on our website. We collect and use personal information (e.g., name, contact details, vehicle information) to provide services, schedule appointments, and communicate with you. By agreeing to these Terms, you acknowledge our data practices, including limited sharing with service providers (e.g., scheduling platforms) under strict confidentiality.

We are not responsible for their content, functionality, or practices. Your use of these third-party services is at your own risk, and you should review their terms and policies.

Babylon Automotive is not liable for delays, cancellations, or failure to perform services due to events beyond our reasonable control, including but not limited to:
- Natural disasters (e.g., hurricanes, floods).
- Supply chain disruptions or parts shortages.
- Government regulations, pandemics, or labor strikes.
- Power outages or equipment failures.
We will notify you of such events and work to reschedule or complete services as soon as practicable.
Changes to These Terms
We may update these Terms to reflect changes in our services, website, or legal requirements. Updates will be posted on our website with a revised “Last Updated” date. Your continued use of our website or services after changes constitutes acceptance of the updated Terms. If you do not agree, you may stop using our services.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or our services will first be addressed through good-faith negotiation. You agree to contact us at Ap@babylon-auto.com to attempt informal resolution within 30 days before pursuing legal action.
If unresolved, disputes will be resolved exclusively in the state or federal courts located in Denton County, Texas. You waive any objections to jurisdiction or venue in these courts. Both parties agree to waive the right to a jury trial, where permitted by law, to streamline resolution.
Compliance with Consumer Protection Laws
We comply with applicable federal and state consumer protection laws, including the Magnuson-Moss Warranty Act and Texas Deceptive Trade Practices-Consumer Protection Act (DTPA). You may have additional rights under these laws, such as remedies for defective services or unfair practices, which these Terms do not waive. For example, the DTPA may allow damages for misrepresentations. Contact us or consult a legal professional for details.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect. We will replace the invalid provision with one that reflects the original intent, to the extent permitted by law.
No Waiver
Our failure to enforce any part of these Terms does not constitute a waiver of our rights to enforce them later. All rights not expressly granted herein are reserved by Babylon Automotive.
Entire Agreement
These Terms, together with any service estimates, invoices, or our Privacy Policy, constitute the entire agreement between you and Babylon Automotive, superseding any prior agreements, communications, or understandings, whether written or oral.
